The Pulaski County School district is being sued by a Texas man for blocking him from the school district’s Facebook page.
Corey DeAngelis filed the lawsuit earlier this week, which seeks a permanent injunction ordering the district and its employees to refrain from blocking DeAngelis or other members of the public from interacting with the district’s official Facebook page based on viewpoint.
The lawsuit also asks for a judgment that the district violated DeAngelis’ First Amendment right to freedom of speech as well as nominal damages and attorney fees.
DeAngelis raised issue with a post on the school district’s Facebook page last year that campaigned against Amendment 2, the school choice bill that was defeated by a 30-point margin statewide.
The Kentucky Attorney General later issued an opinion against the school district’s posts, saying that tax dollars “must not be used to advocate for or against the amendment.”
The lawsuit was filed in the Eastern District of Kentucky. It names the Pulaski County Board of Education, each of its members, the superintendent and the employee acting as administrator of the district’s Facebook page.
