Whittenburg election fraud case dismissed

An election fraud case filed by the unsuccessful candidate for Commonwealth’s Attorney in May’s primary election has been dismissed.

Circuit Judge Sara Beth Gregory dismissed the election fraud case brought by Lee Whittenburg against Matthew Leveridge and the Kentucky Board of Elections yesterday in Wayne Circuit Court.

Whittenburg, who was unsuccessful in the election against Leveridge in May, filed a lawsuit seeking a recount. A recount bond of $15,000 was set by Judge Gregory, and Whittenburg failed to come up with the funds by the deadline, which was set for July 26.

At a hearing in Wayne Circuit Court yesterday, Gregory dismissed the case.
