The Commonwealth’s Attorney’s Office will seek the death penalty against the woman accused of complicity in the murder of Russell County Sheriff’s Deputy Joshua Phipps.
Commonwealth’s Attorney Matthew Leveridge filed the notice in Russell Circuit Court on Friday.
Ashbrook was indicted on charges including complicity to murder in the Phipps case back in February.
The prosecutors office said in the notice they intend to prosecute the case as a capital offense with aggravating circumstances being that the victim was a first responder.
Ashbrook is scheduled for a pre-trial conference in October in Russell Circuit Court.
