The unsuccessful candidate for Commonwealth Attorney who filed a lawsuit alleging election fraud and ballot tampering has taken no steps to move forward on the case, according to Court records.
Lee Whittenburg, a Monticello attorney who was defeated by Matthew Leveridge in the May 21st primary for Commonwealth Attorney, filed his lawsuit in Russell Circuit Court on May 29th and named Leveridge and the Kentucky Board of Elections as defendants. Leveridge, representing himself, filed an answer and denied having knowledge of any wrongdoing. Since those initial filings, Whittenburg has taken no action to further prosecute the case and Leveridge has taken no action to have it dismissed.
County Clerk Patti Glover told WJRS News the cost of the recount in Russell County alone would be about $6,000. Under Kentucky law, that cost would be the responsibility of Whittenburg. Glover also said if no recount is ordered, ballots can be removed from the voting machines 30 days after election date.
